The Historical Scope of Clean Water Act Jurisdiction

The authors look at the Clean Water Act’s legislative and regulatory history to address what waters the law historically covered. They argue that a broad range of waters have been covered and that current and future guidance and regulations should be aimed to restore the Act’s full protections for “waters of the United States.”
