On August 1, 2025, the U.S. Environmental Protection Agency proposed to rescind the 2009 Endangerment Finding—the legal foundation that allows regulation of greenhouse gases (GHGs) under the Clean Air Act. The proposal reinterprets the statute to limit EPA’s authority over global issues like climate change and advances both legal and factual arguments against regulating motor vehicle emissions. Among them: that GHG emissions are not sufficiently linked to climate impacts, and that climate change is less severe than the 2009 finding predicted.
