Session 3: The Clean Air Act and Climate Change Law

Originally enacted in 1963, the Clean Air Act (CAA) is the primary federal law regulating air emissions from stationary and mobile sources. It requires the U.S. Environmental Protection Agency (EPA) to set and update regulations under the Act. In 2009, EPA issued the “Endangerment and Cause or Contribute Finding for Greenhouse Gases Under Section 202(a) of the Clean Air Act,” commonly known as the Endangerment Finding, authorizing the Agency to set emissions standards for greenhouse gases, including carbon dioxide, a major contributor to climate change. But this past February, EPA rescinded its Endangerment Finding, although other legal tools to address climate change remain.

This session of Summer School will explore the foundations of the CAA and climate change law. Expert panelists will discuss recent climate-related developments, such as the recission of the Endangerment Finding, climate litigation, and state climate policy.
