On June 25th, the U.S. Supreme Court released its landmark decision in Monsanto v. Durnell. Monsanto’s Roundup weedkiller (containing the active ingredient glyphosate) faced potential state tort liability in Missouri for alleged failure to warn of the product’s known health risks on its label. The Supreme Court held that the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) expressly preempts state law failure-to-warn claims that would impose a labeling requirement “in addition to or different from” the pesticide label required by the Environmental Protection Agency. The Court concluded that the failure-to-warn claim specifically at issue in the case would impose a labeling requirement – a cancer warning on the label – that would be “in addition to” and “different from” the label required by EPA, and therefore, the claim is preempted by FIFRA.
