Staying on top of the legal and policy developments in the PFAS arena is no small task. As a special service to our members, the Environmental Law Institute provides a series of webinars with authors of the PFAS Deskbook, James Pollack and Isabel Carey, and national experts on PFAS to keep you up to date, answer your questions, and highlight a unique topic related to PFAS during each session.
There is a dearth of data on PFAS contamination in tribal lands. Tribal systems are often too small to meet the U.S. Environmental Protection Agency’s PFAS testing parameters, so very little testing has been conducted. Beyond the gap in knowledge, tribes are distinctly situated from other rural communities due to treaty rights. Many argue that these treaty rights imply a guarantee to a homeland, including land free from contamination. In addition, there is evidence that PFAS bioaccumulates in wildlife, with numerous states having issued fish consumption advisories based on harmful levels of PFAS in freshwater fish species. What PFAS means for tribal food sovereignty in areas where fishing and hunting are not only a means of survival but an important cultural practice is also of concern.
July’s PFAS Briefing will explore how PFAS contamination impacts tribal communities and the complications in remediating tribal lands.
