Summary

The U.S. Army Corps of Engineers’ regulatory program is ultimately based on the public interest balancing process. However, the Harbors and Rivers Act of 1890 made a proposed project’s impact on navigation the Corps’ sole criterion for deciding whether or not to grant a permit for the project, thus narrowing the Corps’ permit evaluation criteria.
