Staying on top of the legal and policy developments in the PFAS arena is no small task. As a special service to our members, the Environmental Law Institute provides a series of webinars with authors of the PFAS Deskbook, James Pollack and Isabel Carey, and national experts on PFAS to keep you up to date, answer your questions, and highlight a unique topic related to PFAS during each session.

When purchasing a current or former industrial property, it is pivotal to understand its environmental conditions and risks. As such, environmental due diligence is crucial to the management of contaminated properties, real estate transactions, corporate mergers and acquisitions, and insurance selection.

Because certain PFAS are now designated as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act, the potential presence of PFOA and PFOS in soil or groundwater may now be considered a recognized environmental concern during a Phase I environmental site assessment (ESA). The broad uses of PFAS across different industries may therefore subject an entirely new set of properties to environmental due diligence. Further, the ASTM Phase I ESA standard provides for an optional review of emerging contaminants that are not yet designated as hazardous substances, which may include any of the thousands of other PFAS compounds.
