Join the Environmental Law Institute and the Pro Bono Clearinghouse for the eighth part of our continuing legal education series on Community Lawyering for Environmental Justice. ELI's Clearinghouse strives to ensure that communities with viable environmental legal matters get the representation they need, whether it be in a courtroom, in front of an agency, or in a more facilitative or consultative fashion. The Clearinghouse connects communities and individuals seeking representation with Clearinghouse members and various collaborating organizations.
This installment will explore how environmental justice communities can use Title VI of the Civil Rights Act of 1964 to advocate for equitable treatment under environmental laws. Title VI prohibits discrimination based on race, color, or national origin, and the administrative complaint process it provides has risen to prominence as a potential solution for addressing state actions that perpetuate environmental inequities. In addition to providing an overview of the Environmental Protection Agency’s Title VI regulations, our panelists will also explore what responsibilities are placed on state agencies, the potential benefits and drawbacks of filing a Title VI complaint, and recent litigation challenging the constitutionality of regulations prohibiting disparate impacts.
