Banks and Fees Searchable Databases

Welcome to the Environmental Law Institute’s searchable databases of wetland mitigation banks and in-lieu-fee programs in the United States. The databases are designed to provide users with access to summary information from wetland mitigation bank enabling instruments, umbrella agreements, and in-lieu-fee program documentation.

Wetland mitigation banks were identified through interviews with the 38 Corps district offices, 50 state wetland managers, and other relevant regulatory agencies. The list of approved and pending mitigation banks and umbrella banks was verified by state wetland regulatory programs and Corps districts in November and December 2001. The majority of the information analyzed was based on banking instruments and bank permits. Relevant documents were obtained for all existing and proposed banks.[1] In general, authorizing instruments or banking instruments were collected for each verified approved wetland mitigation bank. In some instances, additional information, such as permits, bank plans, financial information, and correspondence were collected.

In-lieu-fee programs were identified through interviews with the 38 Corps district offices, 50 state wetland managers, and other relevant regulatory agencies and in-lieu-fee sponsors. The list of approved and pending in-lieu-fee programs was verified by state wetland regulatory programs and Corps districts in November and December 2001. The majority of the information analyzed was based on program agreements and interviews. Relevant documents were obtained for all existing and proposed in-lieu-fee programs.[2] In general, authorizing instruments were collected for each verified approved in-lieu-fee program. In some instances, additional information, such as financial information and site information, were collected.
