Environmental due diligence is the process by which environmental professionals identify, explain, and help manage the economic and legal risks of environmental issues in transactions. Because environmental risks may become legal, financial, and reputational liabilities, environmental due diligence is an essential component of real estate and corporate transactions, but also one that must be very adeptly managed within the larger context of the transaction, the ongoing business, and the regulatory environment.

This online skills workshop will train attorneys and environmental professionals on how to conduct environmental due diligence to assess and manage environmental liabilities associated with a transaction. The relative roles of attorneys, consultants, buyers and sellers will be explored.

After this workshop, participants will understand both the standardized approach to assessing historic, current, and future risks of a property and why there is no “one size fits all” due diligence checklist.

  • The basic legal requirements for and necessity of environmental due diligence.
  • Practical implications of new ASTM E1527-13 requirements and EPA and state regulations applicable to transactions.
  • Key tips on retaining and working with a consultant and attorney.
  • How to manage and communicate with clients and other professionals working on a transaction.
  • Strategies to offer clients to mitigate risks.

This session’s faculty have decades of experience in a wide variety of perspectives and roles regarding due diligence inquiry.
