The In-Lieu Fee Mitigation Training Webinar Series was designed to help states, tribes, and local governments; conservation organizations; and other interested groups develop or refine rigorous in-lieu-fee programs that yield ecologically effective and sustainable compensatory mitigation. The series of webinars focuses on specific subjects, providing in-depth technical support on the topics of most interest to participants. The topics were chosen with the assistance of an Advisory Committee based on an assessment of the needs of states, tribes, and local governments and conservation organizations seeking approval for or overseeing the approval of statewide or regional in-lieu fee programs.

In 2009, ELI published model language that could be incorporated into in-lieu fee program instruments being developed by state agencies and non-profit organizations. The report, funded by the U.S. Environmental Protection Agency, was designed to comply with the 2008 Compensatory Mitigation Rule. It was developed using the best available information and uses examples from the approved and draft in-lieu fee instruments that were available as of December 2009.

Advance Credits

The first webinar featured Steve Martin from the US Army Corps of Engineers Institute for Water Resources, who focused on the topic of advance credits. Mr. Martin described different approaches to determining advance credits and talked about the interplay between advance and released credits.
