An ELI Public Webinar In the United States, nearly 100,000 deaths per year are attributed to fine particle pollution. People of color are three times more likely to face exposure to this deadly air pollution, twice as likely to live near landfills and industrial plants, which may increase the risk of being exposed to air and water pollutants, and more likely to be exposed to unsafe drinking water, as seen most notably in the recent Flint water crisis. These statistics reveal a repeated and disturbing pattern of environmental racism. Environmental racism refers to the institutional rules, policies, or decisions that result in the disproportionate impact of environmental hazards on marginalized communities. Since the term was coined in the 1980s, events including the 1982 Warren County PCB Landfill, the seminal “1987 Toxic Waste in the United States” report, and protests over pipeline construction on indigenous Americans’ historic land have highlighted these stark disparities. What is the history of the modern environmental justice movement in the United States? What are the ongoing injustices facing communities of color, and how are stakeholders – including city, state, and federal government, community groups, non-profits, and others – responding? What are the opportunities for and challenges to dismantling environmental racism? Co-sponsored by the International Network for Environmental Compliance and Enforcement (INECE) Indigenous peoples inhabit territories that contain over 80% of the Earth’s remaining biodiversity. However, Indigenous communities and lands are frequently under pressure from extractive interests, illegal logging or poaching and encroaching farmland. Community science has the potential for improving compliance with laws designed to protect natural resources, especially in areas where indigenous people are located. This is because Indigenous peoples often must deal with additional barriers to adequate enforcement of environmental rule of law in their territories including lack of attention from some government authorities, lack of governmental resources, or in some cases the difficulty in accessing activities on their lands.. In these circumstances, community science and monitoring tools can serve as a powerful mechanism for communities to take action when environmentally harmful activity is happening on their lands. There have been various innovations in Indigenous and remote communities where monitoring is ongoing, including community patrols and technologies that work without consistent cellular or internet services.

An ELI & Babst, Calland, Clements and Zomnir, P.C. Co-Sponsored Webinar The United States is experiencing a wave of state-led clean transportation initiatives that are gaining substantial momentum. Faced with insufficient action on the federal level to reduce greenhouse gas (GHG) emissions, states are focusing their efforts on the sector that produces the largest percentage of GHG: transportation. Around the country, states are taking various avenues to curb emissions from the transportation sector. California has adopted low emission limits for light-duty vehicles and targeted transportation segments with new regulations, including the Advanced Clean Trucks Regulation. Other states are setting requirements for transportation network companies (TNCs) to curb emissions. Several states are forming new regional initiatives including the Transportation and Climate Initiative and the Multi-State Medium- and Heavy-Duty Zero Emission Vehicle Memorandum of Understanding. Still others are developing charging infrastructure initiatives, expanding the grid to promote electric vehicles, investing in electric vehicle government fleets and rebates for private customers, and more. An ELI Public Webinar Nearly half of Fortune 500 companies have set a greenhouse gas (GHG) emissions target with renewable electricity as a central component in their commitment to tackle climate change. To achieve these goals, companies—in deciding where to invest in new facilities and infrastructure—are prioritizing locations with electric grid infrastructure that offers low- or zero-carbon electricity. In a new report, David Gardiner & Associates investigated the role of cities’ electricity sourcing and how that plays into enticing companies to bring businesses and jobs to their area. Do fast-growing cities, such as Austin, Charlotte, Indianapolis, and Nashville, compete for new businesses based on the availability of the renewables and the carbon emissions of their electric grids? How are utilities addressing demands for renewable or low-carbon power by some of the largest corporations? Because these crises present serious societal challenges that affect large slices of America, however, they must be addressed—and resolved—in an open, fair, and equitable fashion. Looking Back to Move Forward: Resolving Health & Environmental Crises, a new book from the New York University School of Law’s State Energy & Environmental Impact Center, describes the tools that advocates, judges, legislators, and policymakers have applied to address and resolve—with varying levels of success—seven major health and environmental crises of our time. With chapters written by leading legal practitioners and policy experts, the book provides a comprehensive, independent analysis of prior judicial and legislative settlement structures employed to resolve the toughest large-scale health and environmental liability and compensation challenges over the last 50 years. ELI’s Annual Eastern Boot Camp on Environmental Law® is an overview of environmental law from the top experts in the field. Boot Camp is designed primarily for attorneys and environmental managers new to environmental law, although more experienced professionals have found the course provides an efficient update as well. While the course has a strong legal focus, it is accessible to professionals other than lawyers, including corporate environmental managers, paralegals, and technical staff who would benefit from a more thorough understanding of environmental law. ELI’s Eastern Boot Camp on Environmental Law® is led by carefully selected senior practitioners and environmental managers who provide a practical and pragmatic view of environmental law and policy issues likely to be encountered by those working in the field. Annual topics include sessions on: NEPA, ESA, CWA, civil and criminal enforcement, TSCA, FIFRA, energy law, CAA, RCRA, CERCLA, due diligence in transactions, and ethics. Please note: ELI's Boot Camp on Environmental Law® is available only to the member firms and organizations of ELI’s Professional, Corporate, and Public Interest Programs and to individual ELI Associates Program members. Co-sponsored by the International Network for Environmental Compliance and Enforcement (INECE) Citizen science presents an opportunity for environmental agencies to obtain data that they can use for regulatory, enforcement and management decision-making. However, while programs such as volunteer water monitoring have existed for many years, broader agency strategies for making use of such information are still emerging. Some agencies have developed guidelines and frameworks to support citizen science initiatives, but most are still learning how to make use of data that comes from unconventional sources. For the fifth session of INECE’s webinar series on citizen science and environmental enforcement, we will be joined by environmental agency representatives from different countries who will describe what their governments are doing to utilize and encourage citizen science, and the extent to which those strategies are being adopted by their environmental agencies. During the session, we will showcase these examples and explore successes, opportunities, barriers, limitations, challenges, and future possibilities for agency use of citizen science.
