Radon Control in New Home Construction

Developments in State Policy

Massachusetts

Massachusetts law directs the Board of Building Regulations and Standards (BBRS) to develop a state building code applicable throughout the state. See Mass. Gen. Laws c. 143. In September 2014, the BBRS approved an amendment to the Massachusetts Residential Code requiring radon control features in new one- and two-family dwellings and townhouses of three stories or less.  The new code requirement applies only in Zone 1 (high potential) radon counties in Massachusetts (Essex, Middlesex and Worcester counties). The BBRS adopted an amended version of the International Residential Code (IRC) Appendix F, which is applicable to covered new residential construction. Alternatively, the code allows use of ANSI/AARST Standard CCAH; however the code explicitly states that radon testing is not required as a condition of issuing a certificate of occupancy. See 780 Code Mass. Regs. Chap. 51, App. F.
