In-Lieu Fee Mitigation Training Webinar Series: Credit Determination

The In-Lieu Fee Mitigation Training Webinar Series was designed to help states, tribes, and local governments; conservation organizations; and other interested groups develop or refine rigorous in-lieu-fee programs that yield ecologically effective and sustainable compensatory mitigation. The series of webinars focuses on specific subjects, providing in-depth technical support on the topics of most interest to participants. The topics were chosen with the assistance of an Advisory Committee based on an assessment of the needs of states, tribes, and local governments and conservation organizations seeking approval for or overseeing the approval of statewide or regional in-lieu fee programs.

Credit Determination

Approved mitigation plans must include a description of the number of credits to be provided at a mitigation site, including a brief explanation of the rationale for this determination. (See §332.4(c)(6)) The federal compensatory mitigation regulations define the term “credit” as “a unit of measure (e.g., a functional or areal measure or other suitable metric) representing the accrual or attainment of aquatic functions at a compensatory mitigation site. The measure of aquatic functions is based on the resources restored, established, enhanced, or preserved.”  33 C.F.R. § 332.2. For this webinar, Justin Hammonds (USACE, Savannah District) will discuss credit determination methodologies, focusing on the stream credit determination methodology employed by the Savannah District. Then, Ruth Ladd (USACE, New England District) will discuss crediting for preservation and non-aquatic resources and Nicole Maness (Willamette Partnership) will present Willamette Partnership’s Ecosystem Credit Accounting System. Finally, Will Harman (Stream Mechanics) will discuss the top issues to consider when determining stream credits.
