Environmental due diligence is the process by which environmental professionals identify, explain, and help manage the economic and legal risks of environmental issues in transactions. Because environmental risks may become legal, financial, and reputational liabilities, environmental due diligence is an essential component of real estate and corporate transactions, but also one that must be very adeptly managed within the larger context of the transaction, the ongoing business, and the regulatory environment.
This online skills workshop trained attorneys and environmental professionals on how to conduct environmental due diligence to assess and manage environmental liabilities associated with a transaction. The relative roles of attorneys, consultants, buyers and sellers were explored.
The event provided participants with an understanding of both the standardized approach to assessing historic, current, and future risks of a property and why there is no “one size fits all” due diligence checklist.

- Practical implications of new ASTM E1527-13 requirements and EPA and state regulations applicable to transactions.
