Radon Control in New Home Construction:
Developments in State Policy

Maryland

 

Maryland law directs the state Department of Housing and Community Development to adopt Maryland Building Performance Standards (“Standards”). The Standards apply throughout the state and are enforced at the local level; however local jurisdictions have authority to adopt local amendments to modify the Standards. See Md. Public Safety Code §§ 12-503, 504. The law directs the Department to incorporate the International Building Code into the Standards, with modifications as determined by the Department. Effective January 2010, the Department has promulgated regulations incorporating the 2009 International Residential Code into the state Standards, and has adopted Appendix F as part of the IRC. See Md. Admin. Code § 05.02.07.04(C)(1). Pursuant to the state law, local jurisdictions must implement the state Standards — including any local amendments — within 6 months of the effective date.
