This law requires that all construction and renovation of public buildings (defined to include schools) receiving 50% or more in funding from the Commonwealth meet the high performance building standards to be promulgated by the Cabinet for Finance with advice from a High-Performance Buildings Advisory Committee established in the law. The Cabinet promulgated regulations establishing LEED as the standard, requiring projects that cost $25 million or more to achieve LEED Silver certification, projects between $5 million and $25 million to achieve LEED Certified certification, and projects under $5 million to use LEED criteria as a guide. The regulations provide for the granting of exemptions in cases that demonstrate that there is “extraordinary undue burden” or that it will otherwise be in the best interest of the Commonwealth.
